A working guide to Class 42 — the classification most relevant to software, SaaS, and technology companies — and why getting it right matters for online filings.

For software, SaaS, and technology companies, Class 42 of the Nice Classification is usually the most relevant filing category. It covers “scientific and technological services,” including software design, development, and hosting — but it is frequently misapplied by founders unfamiliar with how the Registry's online filing portal categorizes technology offerings.

What Class 42 Actually Covers

  • Design and development of computer software (including SaaS platforms and mobile applications)
  • Cloud computing and server hosting services
  • Software-as-a-Service (SaaS) provision
  • Research and technical consultancy related to software

Class 42 does not cover downloadable software products themselves (which typically fall under Class 9), nor does it cover business consulting or advertising functions performed through a software platform (which may fall under Class 35). SaaS companies with a hybrid offering — a downloadable component plus a hosted service — often need to file in both Class 9 and Class 42 for complete coverage.

Filing Practically Through the Online Portal

The Registry's e-filing system (IP India's online trademark portal) requires applicants to select specific pre-approved descriptions of goods/services within each class, or submit a custom description for examiner review. For Class 42 filings, using the Registry's standard pre-approved SaaS/software development descriptions generally results in faster examination than a heavily customized description, which may attract a classification objection and delay the process.

Why This Matters for Filing Timelines

Classification-related objections are procedural (rather than substantive, like Section 11 similarity objections) but still add several months to the examination timeline if the initial filing is imprecise. A properly scoped Class 42 description, cross-checked against your actual product offering, is one of the simplest ways to avoid this entirely.
